OUTREACH - “EDEN STUDIO & THERAPY”

CLIENT MEMBERSHIP & LIABILITY RELEASE

By joining Spirit of Health Ministries, a Private Ministerial Association, and/or any Outreach, website, app, or Social Media Group started by, created by, maintained, or organized by the Association, I agree to the terms and conditions of Spirit of Health Ministries, a Private Ministerial Association, agreement as follows.

 1. This Association of members declares that our objective is to allow the Private Ministerial Association Founders and all Private Ministerial Association members a platform in which to conduct all manner of private business with the Association and with other Associations and Association members, keeping all business in the private domain and utilizing the protections guaranteed by the Universal Declaration of Human Rights (UDHR), and the Constitutions to conduct business in private and to provide a platform for members to conduct business in the private domain under all protections acknowledged and guaranteed by the Constitution of the United States of America, and any previous protections guaranteed. 

2. We believe that the Holy Scriptures, the Universal Declaration of Human Rights (UDHR), the Constitution of the United States of America, the various Constitutions of the several states of the union, and the Canadian Bill of Rights guarantee our members the rights of absolute freedom of religion, free speech, petition, assembly, and the right to gather together for the lawful purpose of helping one another in asserting our rights protected by those Constitutions, Canadian Bill of Rights and Statutes, in addition to the rights to be free from unreasonable search and seizure, the right not to incriminate ourselves, and the right to freely exercise all other unalienable rights as granted by our Creator, our Almighty God and guaranteed by those Constitutions, Canadian Bill of Rights and Statutes. 

WE HEREBY Declare that we are exercising our right of “freedom of association” as guaranteed by the Universal Declaration of Human Rights (UDHR), the Constitution of the United States of America, and equivalent provisions of the various State Constitutions, as well as the Canadian Bill of Rights. This means that our Association activities are restricted to the private domain only and outside of the jurisdiction of government entities, agencies, officers, agents, contractors, and other representatives as provided by law.

 3. We declare the basic right of all of our members to decide for themselves which Association members could be expected to give wise counsel and advice concerning all matters including, but not limited to, physical, spiritual, and mental health care assistance, law, and any other matter and to accept from those members any and all counsel, advice, and tips, whom we feel are able to advise and assist us properly.

 4. We expect the freedom to choose and perform for ourselves the types of therapies and treatments that we think best for diagnosing, treating, and preventing illness and disease and for achieving and maintaining optimum wellness, as well as the freedom to choose for ourselves any types of assistance which may be made regarding law and any other private business activity.

 5. The mission of this Association is to provide members with a forum to conduct business between members in the private domain with the protections guaranteed within the aforesaid Constitution, Canadian Bill of Rights, and all other protections remaining fully intact. 

6. The Association will recognize any person(s), natural or otherwise (irrespective of race, color, or religion) who has joined this Association or any outreach or social media group organized, created, or managed by this Association and is in agreement with these principles and policies as a member of this Association, providing said person has not been sanctioned, exercised, or otherwise banned by the Association, and will provide a medium through which its individual members may associate for actuating and bringing to fruition the purposes heretofore declared.

 7. Membership in this Association, "Spirit of Health Ministries," and any of its groups may be terminated by the Association Trustees or their designee at any time if they conclude that a specific member is interacting with them or any other members in a way that is contrary or detrimental to the focus, principles, and betterment of this Association. 

8. I understand that since The Association is protected by the First and Fourteenth Amendments to the Constitution of the United States of America, it is outside the jurisdiction and authority of Federal and State Agencies and Authorities concerning any and all complaints or grievances against The Association members or other staff persons. All rights of complaints or grievances will be settled by an Association designee, committee, or tribunal and will be waived by the member for the benefit of The Association and its members. By agreeing to this membership form, I have sought sufficient education to determine that this is the course of action I want to take for myself.

9. I agree to join Spirit of Health Ministries, a Private Ministerial Association under common law, whose members seek to help each other achieve improved spiritual health, better physical health, and good quality of life.

(A) I am voluntarily changing my capacity from that of a public person to that of a private member.

My activities within The Association are a private contractual matter that I refuse to share with the Local, State, or Federal investigative or enforcement agencies. I fully agree not to pursue any course of legal action against a fellow member of The Association unless that member has exposed me to a clear and present danger of substantive evil and upon the recommendation and approval of the Association.

10. I enter into this agreement of my own free will without any pressure or coercion. I affirm that I do not represent any Local, State, or Federal agency whose purpose is to regulate and approve products or services or to carry out any mission of enforcement, entrapment, or investigation. I have read and understood this document, and my questions have been answered fully to my satisfaction. I understand that I can withdraw from this agreement and terminate my membership in this Association at any time and that my membership can and will be revoked if I engage in abusive, violent, menacing, destructive, or harassing behavior toward any other member of The Association. These pages consist of the entire agreement for my membership in The Association.

I agree this contract began on the date of my joining "Spirit of Health Ministries." I have carefully read the whole of this document, and I understand and agree with it.

Terms of Service & Waiver of Liability

These Terms of Service form a legal agreement between Spirit of Health Ministries, a Private Ministerial Association and its outreach Eden Studio & Therapy (“Eden Studio & Therapy”), and the individual completing registration for Eden Studio & Therapy services, which include Pilates, fitness, and dance, as well as therapy services, whether in-person or at www.edenstudiokc.com (hereafter, “I,” “me,” “my”) and regardless of whether the services are delivered in-person or virtually/electronically on my device or personal computer.

PILATES, FITNESS, & DANCE: Release and Waiver of Liability

1. I understand that the process of doing Pilates, fitness, or dance may involve dialogue, questions regarding my history, previous injuries, current status, etc., and that my clear and complete responses to these questions will determine the quality and safety of the exercises.

2. I understand that Pilates involves unique equipment that I may not be familiar with, that the equipment is constructed of moving parts, springs, and levers, and that the movement of my body and the apparatus could result in the possibility of falling or being trapped by the moving parts. I understand that my clear and focused involvement is necessary for my physical improvement and safety.

3. I understand that my participation may require the instructor to move me or ask me to move my body in ways that are new to me, and it is possible that in these movements, pain or injury may occur or be exacerbated. I understand that it is my responsibility to communicate clearly and promptly with my instructor, telling the instructor of any pain, discomfort, medical findings, or physical limitations. I understand that it is my responsibility to stop any movement or exercise that I feel is too much for me or may cause me pain or injury.

4. I understand that it is my sole responsibility to consult with a physician prior to my participation in the services at Eden Studio & Therapy to determine my fitness level and safety of participation. I represent and warrant that if I have recently experienced a new injury or illness, if I am or may be pregnant, if I am postpartum, or if I have concerns of osteoporosis, multiple sclerosis, or other significant neurological or physical dysfunction, I have consulted with my physician and obtained my physician’s approval for participation.

5. I recognize and understand that there are risks of physical injury inherent in participation in any physical exercise program and that those risks are increased with the use of exercise equipment, particularly the unique equipment used in Pilates instruction. I also understand that exercise equipment, particularly the moving parts, may be subject to fatigue or other wear and tear that may not be readily apparent to the user or to the studio. I KNOWINGLY ASSUME THE RISKS INVOLVED IN TAKING PILATES INSTRUCTION (WHETHER IN-PERSON OR ONLINE) AND USING PILATES EQUIPMENT.

6. I represent and warrant that I am at least 18 years old. Alternatively, I agree that if I am under 18 years old, I will disclose my age to Eden Studio & Therapy and have my parent or legal guardian sign a release form.

7. I understand that any audio or video recording of my sessions is strictly prohibited unless expressly agreed to in writing by Eden Studio & Therapy. I promise and agree that I am using the services for my own personal, noncommercial purposes and will not redistribute and transfer the services to anyone else. I agree that I will not provide my password or other account information to anyone else or knowingly allow someone else to use my password or other account information to access the services.

8. IN FURTHER CONSIDERATION FOR MY PARTICIPATION AT EDEN STUDIO & THERAPY, I KNOWINGLY, VOLUNTARILY, AND EXPRESSLY WAIVE AND RELEASE ANY CURRENT OR FUTURE CLAIM I MAY HAVE AGAINST EDEN STUDIO & THERAPY, ITS MEMBERS, CONTRACTORS, INSTRUCTORS, MANAGERS, OFFICERS, AGENTS, SUCCESSORS AND ASSIGNS (THE “RELEASEES”) ARISING OUT OF OR ATTRIBUTABLE TO MY PARTICIPATION IN THE EXERCISE & DANCE CLASSES, WHETHER ARISING OUT OF THE NEGLIGENCE OF EDEN STUDIO & THERAPY, OR ANY RELEASEES OR OTHERWISE. I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST EDEN STUDIO & THERAPY, OR ANY OTHER RELEASEE, AND FOREVER RELEASE AND DISCHARGE EDEN STUDIO & THERAPY AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS. 

9. These Terms of Service and any dispute or controversy arising out of or related thereto (“Claims”) and shall be governed by and construed, interpreted, and resolved in accordance with the laws of the State of Missouri without regard to its choice of law provisions; provided, however, that any procedural or substantive Claim conflicting with or falling under the exclusive jurisdiction of United States federal law shall be governed by, and construed, interpreted and resolved in accordance with United States federal law without regard to its choice of law provisions. All Claims shall be submitted exclusively to the federal and state courts of competent jurisdiction located in Kansas City, Missouri, and the parties hereby unconditionally and irrevocably consent and submit to such exclusive jurisdiction and venue and waive any objection they may now or hereafter have with respect thereto.

I have read the above Terms of Service and fully understand its contents. I voluntarily agree to the terms and conditions stated above.

THERAPIES: Release and Waiver of Liability

The individual named below (“I” or “me”) desires to participate in one or more therapy sessions provided by Spirit of Health Ministries, a Private Ministerial Association and its outreach Eden Studio & Therapy (“Eden Studio & Therapy”), which may include but is not limited to, one or more of the following forms of therapy: Far Infrared Sauna, iMRS, Lymph Vibra Therapy, True Rife, IonCleanse Foot Bath, Cold Laser, Neurofeedback or any other forms of therapy provided by Eden Studio & Therapy (collectively and individually, the “Sessions”).  As lawful consideration for being permitted by Eden Studio & Therapy to participate in the Sessions and the intangible value that I will gain by participating in the Sessions, I agree to all the terms and conditions set forth in this agreement (this “Agreement”).

Services Disclaimer. I understand and realize that the Spirit of Health Practitioners & Eden Studio & Therapy Staff are lay natural health advisors and NOT medical doctors or licensed physicians. I understand that the Sessions are in no way medical treatments, nor are they intended to diagnose, treat, prescribe, advise, or cure any condition. I understand that the Sessions do not guarantee any particular health-related results. I understand that the Sessions cannot determine specific disease conditions I may or may not have and do not replace diagnostic services offered by a licensed physician.

Assumption of Risk.  I am aware of and understand the risks inherent in the use of the particular therapy utilized during the Sessions.  I VOLUNTARILY ASSUME THE RISK OF INJURY, ACCIDENT, OR DEATH THAT MAY ARISE FROM THE USE OF THE PARTICULAR THERAPY UTILIZED DURING THE SESSIONS. I acknowledge that I have received and read the instructions and warnings for the particular therapy utilized during the Sessions.

Liability Release. IN FURTHER CONSIDERATION FOR MY PARTICIPATION IN THE SESSIONS, I KNOWINGLY, VOLUNTARILY, AND EXPRESSLY WAIVE AND RELEASE ANY CURRENT OR FUTURE CLAIM I MAY HAVE AGAINST EDEN STUDIO & THERAPY, ITS MEMBERS, CONTRACTORS, INSTRUCTORS, MANAGERS, OFFICERS, AGENTS, SUCCESSORS, AND ASSIGNS (THE “RELEASEES”) ARISING OUT OF OR ATTRIBUTABLE TO MY PARTICIPATION IN THE SESSIONS, WHETHER ARISING OUT OF THE NEGLIGENCE OF EDEN STUDIO & THERAPY OR ANY RELEASEES OR OTHERWISE. I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST EDEN STUDIO & THERAPY OR ANY OTHER RELEASEE AND FOREVER RELEASE AND DISCHARGE EDEN STUDIO & THERAPY AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS.  I understand that any foods or supplements I choose to consume or any natural therapies I choose to pursue are at my own discretion, of my own free will, and at my own risk. I also understand that all third-party information in the form of fliers, pamphlets, and articles I received are for informational and educational purposes only and do not necessarily reflect the viewpoints of Eden Studio & Therapy. I further acknowledge and agree all waivers, releases, and covenants made herein are binding on me, my family, my estate, heirs, or legal representatives.

I further acknowledge that I am responsible for contacting and consulting with my primary care physician before starting or engaging in any natural health program, diets, supplements, or therapies. I will not discontinue, change, or alter any medications or therapies that have been prescribed for me by a physician without first consulting the prescribing physician. I certify that I am participating in the Sessions and all further communication with Eden Studio & Therapy, whether in person or by mail, telephone, email, text message, video conference, or any other form of electronic communication, solely on my own behalf and not as an agent or representative of any federal, state, county, or local government or private agency on a mission of investigation.

This Agreement constitutes the sole and entire agreement of Eden Studio & Therapy and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of the Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other jurisdiction. This Agreement is binding on and shall inure to the benefit of Eden Studio & Therapy and me and their respective successors and assigns. All matters arising out of or relating to the Agreement shall be governed by and construed in accordance with the internal laws of the State of Missouri without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Jackson County, Missouri. I hereby consent to the exclusive jurisdiction of such courts.

Consent. By checking this box and submitting this form, I agree this contract began on the date of my joining "Spirit of Health Ministries." I have carefully read the whole of this document, and I understand and agree with the terms of membership and the waiver and release.
